Terms of Service

These Terms of Service govern your access to and use of products, services, websites, checkout pages, communications, and digital resources provided by Agency Partners Group LLC dba Stacking Capital ("Stacking Capital," "we," "us," or "our").

By purchasing from us, using our website, booking a call, submitting information, signing an agreement, or participating in our program, you agree to these Terms and any written agreement you sign with Stacking Capital.

Who we are

Stacking Capital is a business funding advisory and consulting firm. We help business owners understand and improve funding readiness, organize business and credit profiles, plan lender/application sequencing, prepare for applications, and navigate business-credit and capital strategy.

Stacking Capital is not a bank, lender, credit card issuer, credit bureau, loan broker, mortgage broker, credit repair organization, law firm, CPA firm, investment adviser, or financial planner.

Services

Depending on the program purchased, Stacking Capital services may include:

  • onboarding and discovery;
  • personal and business profile review;
  • business credit and bankability review;
  • funding-readiness planning;
  • application sequencing and strategic guidance;
  • review of business entities, banking footprint, utilization, documentation, and readiness factors;
  • live strategy calls, Zoom calls, phone calls, email, SMS, CRM communications, and follow-up support;
  • digital checklists, profile sheets, action items, training resources, or other advisory materials;
  • coordination with independent third-party providers when appropriate.

Our services are advisory and consultative. You remain responsible for deciding whether to apply for any product, submitting accurate information, reviewing all terms from third-party banks/lenders/issuers, and repaying any credit or financing you obtain.

No lending or underwriting control

All approvals, denials, credit limits, APRs, terms, underwriting decisions, account reviews, account closures, reconsideration outcomes, and funding timelines are controlled by third-party banks, lenders, issuers, bureaus, and service providers. Stacking Capital does not control those decisions.

We do not guarantee:

  • approval from any lender, issuer, or bank;
  • any specific funding amount or credit limit;
  • any specific APR, rate, term, or promotional period;
  • approval by any deadline;
  • that any account will remain open after approval;
  • removal of any credit-report item;
  • any credit score increase;
  • any business, investment, tax, legal, or financial result.

Client responsibility

You agree to:

  • provide accurate, complete, and truthful information;
  • review all recommendations and third-party terms carefully;
  • make your own final decisions about applications, credit, debt, banking, and business actions;
  • submit only truthful information to banks, lenders, issuers, bureaus, and third parties;
  • attend scheduled calls or reschedule with reasonable notice;
  • provide required documents, reports, access, and updates promptly;
  • avoid applying outside the agreed strategy without understanding that doing so may affect your results;
  • maintain professional communication with our team.

We may pause or limit services if you do not provide required information, miss calls, stop responding, provide inaccurate information, misuse the program, ask us to submit false information, or otherwise prevent us from performing the services.

Credit repair and third-party providers

Stacking Capital does not perform credit repair, credit disputes, or credit bureau correspondence. If credit repair or another regulated service is relevant to your plan, that service may be provided by an independent third-party provider under that provider's own agreement, disclosures, cancellation rights, and policies.

Any independent provider is responsible for its own services. Stacking Capital may coordinate, track, or discuss strategy around the overall funding plan, but Stacking Capital does not become a credit repair organization by doing so.

Fees and payments

Prices, payment terms, deposits, performance fees, installment terms, and due dates are stated at checkout and/or in your signed agreement. You authorize Stacking Capital and its payment processors to charge the payment method you provide for amounts due.

Payments are non-refundable once services begin, onboarding or access is provided, or custom work starts, except where a signed agreement or applicable law requires otherwise. See our Return and Refund Policy.

Chargebacks

If you believe there is an issue with your service, you agree to contact us first so we can review the issue and attempt to resolve it. A chargeback or payment dispute does not cancel your agreement or eliminate amounts owed.

If a valid charge is disputed, we may provide the payment processor, card network, bank, collections provider, legal counsel, or other permitted recipient with evidence of the transaction and service delivery, including your agreement, order records, policy records, communications, call logs, onboarding records, digital access records, and service history.

Communications, calls, and recordings

You agree that Stacking Capital may communicate with you by email, phone, SMS/text message, CRM messaging, video call, and other business channels for service, account, scheduling, billing, and support purposes.

Calls and meetings may be recorded or transcribed for service quality, internal review, compliance, training, and recordkeeping. If you do not consent to a recorded call, tell us before continuing the call.

Marketing communications will include opt-out options where required. You can opt out of marketing emails using the unsubscribe instructions in the email and can opt out of SMS marketing by replying STOP where applicable.

Privacy and data security

Your use of our services is also governed by our Privacy Policy. Because our advisory work may involve sensitive business, financial, credit, and identity information, you agree to use secure channels when we request them and not to send sensitive passwords or credentials through unsecured SMS or email unless specifically instructed otherwise through an approved process.

No professional advice

Information provided by Stacking Capital is for business funding advisory and educational purposes only. It is not legal, tax, accounting, investment, insurance, or financial-planning advice. You should consult your own attorney, CPA, tax advisor, financial advisor, or other professional before making decisions requiring professional advice.

Intellectual property

All materials, checklists, frameworks, scripts, templates, videos, documents, training, strategy materials, and digital resources provided by Stacking Capital are owned by Stacking Capital or its licensors. You may use them only for your own internal business purposes during your engagement. You may not copy, resell, publish, distribute, train AI systems on, or commercially exploit our materials without written permission.

Website and program misuse

You may not use our website, checkout, services, or materials for unlawful purposes, to submit false information, to interfere with our systems, to scrape or copy our content, to impersonate another person, or to misrepresent your identity, business, credit, income, revenue, documents, or funding purpose.

Conflicts with signed agreements

If you sign a separate written agreement with Stacking Capital and that agreement conflicts with these website Terms, the signed agreement controls for your program to the fullest extent allowed by law.

Changes

We may update these Terms from time to time. The version posted on our website applies to website use going forward. For already-signed program agreements, the signed agreement controls unless the parties agree otherwise in writing.
